WHO THIS AGREEMENT IS BETWEEN

These Terms of Service ("Terms") are an agreement between you and Conflict Simulations LLC ("Retrogaze," "we," "us") governing your use of the Retrogaze website, web app, and API at retrogazeai.com (the "Service"). By creating an account, generating a sprite, subscribing to a paid plan, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is part of this agreement.

If you don't agree to these Terms, don't use the Service. You can still read how the tool works without an account — generation without signing in is allowed and doesn't require agreeing to anything beyond acceptable use, below.


AGE AND ACCOUNT ELIGIBILITY

You must be at least 13 years old to create an account. If you're under the age of majority where you live, you need a parent or guardian's permission to agree to these Terms and to any paid subscription. We don't knowingly collect account information from children under 13; see the Privacy Policy for more on this.

You're responsible for keeping your login credentials secure and for everything that happens under your account, whether you signed up with an email and password or through Google or GitHub sign-in. Tell us if you think your account has been compromised.


WHAT RETROGAZE ACTUALLY DOES

Retrogaze generates pixel-art sprites and tiles by sending your text description (and, if you provide one, a reference image) to fal.ai, a third-party AI image generation provider, which returns a draft image. Retrogaze then processes that draft through its own constraint-enforcement pipeline — palette snapping, tile-grid alignment, per-console color budgets — to produce the final output. Aseprite mode works differently: it runs entirely in your own Claude client via the Retrogaze MCP server, using your own Anthropic credentials, which never pass through Retrogaze's servers.

Generated images pass through fal.ai's own content-safety checks before they're returned to you. See our Ethics page for the fuller explanation of what the tool is for and what it isn't — a prototyping aid for developers who can't draw, not a replacement for hiring a pixel artist once you're shipping a real game.

We don't guarantee that generated output is free of errors, visually consistent, or fit for any particular purpose. Treat everything the Service produces as a draft.


WHAT YOU CAN'T DO WITH IT

Violating any of this can get your account suspended or terminated, with or without a refund, depending on severity — see the payment section below for how refunds actually work.


OWNERSHIP OF GENERATED SPRITES

You own what you generate. The sprites, tiles, and other assets you create through Retrogaze are yours — use them in personal or commercial projects, modify them, redistribute them, without attribution to Retrogaze.

Two caveats worth knowing about, not because we're trying to hedge, but because they're genuinely outside our control: first, in some jurisdictions, purely AI-generated images without meaningful human creative input may not qualify for copyright protection at all — this is unsettled law, not a Retrogaze policy choice. Second, the underlying image model is general-purpose infrastructure operated by fal.ai; we pass through whatever rights fal.ai's own terms grant on its outputs, and we don't independently guarantee a broader license than that.

We don't claim ownership of your prompts or your generated output, and we don't use them to train any model. We may look at aggregated, de-identified usage patterns (which asset types are popular, which consoles get used most) to improve the product — never your specific prompts or images tied back to you, published or shared externally.


HOW BILLING ACTUALLY WORKS

Paid tiers (Starter, Pro, Studio) are billed monthly or annually through LemonSqueezy, who acts as the merchant of record for every transaction. That means your card statement shows a LemonSqueezy charge, LemonSqueezy handles sales tax/VAT collection and remittance, and LemonSqueezy — not Retrogaze — processes your payment details directly. We never see or store your full card number.

You can manage or cancel your subscription at any time from your account's billing portal, which is hosted by LemonSqueezy. Cancelling stops future renewals; you keep access through the end of the period you already paid for. If your payment fails, your account moves to a past-due state and paid features pause until it's resolved.

Refunds go through LemonSqueezy, our merchant of record, following their own buyer-protection and dispute process — we don't run a separate Retrogaze refund program on top of it. If you want a refund, start with LemonSqueezy's support (linked from your billing portal or receipt email); you can also reach us at [email protected] and we'll point you the right way.

If a refund is issued — whether through LemonSqueezy's process or at our request — your account is downgraded to the free tier automatically, the same as if the subscription had simply expired. We don't distinguish partial refunds from full ones for this purpose: any processed refund on an order ends the paid access tied to it.

Generation limits reset on your billing cycle, not the calendar month, for annual plans. Unused generations don't roll over between cycles unless we say otherwise in-app.


API KEYS AND THE MCP SERVER

If your tier includes API or MCP access, you can generate API keys from your account settings. Keys are shown in full only once at creation — store them securely. You can hold up to 10 active keys and revoke any of them at any time; revocation is immediate and irreversible. You're responsible for anything done with a key issued to your account, so revoke it right away if you think it's leaked.


WARRANTY DISCLAIMER & LIMITATION OF LIABILITY

The Service is provided "as is" and "as available," without warranties of any kind, express or implied — including, without limitation, any warranty of merchantability, fitness for a particular purpose, or non-infringement. We don't promise the Service will be uninterrupted, error-free, or that generated output will meet your expectations.

Retrogaze depends on third-party infrastructure (fal.ai for image generation, Supabase for accounts and storage, LemonSqueezy for billing) that we don't control. We're not liable for outages, data loss, or errors caused by those providers' systems being down, changing their terms, or discontinuing service.

To the maximum extent permitted by law, Retrogaze's total liability to you for any claim arising from your use of the Service is limited to the amount you paid us in the twelve months before the claim arose (or $50 if you're on the free tier). We're not liable for indirect, incidental, special, or consequential damages, including lost profits or lost data, even if we've been told those losses were possible.

Nothing in this section limits liability where it can't be limited under applicable law (for example, liability for our own fraud, or for death or personal injury caused by our negligence, in jurisdictions that don't allow that liability to be excluded).


SUSPENSION, TERMINATION, AND ACCOUNT DELETION

You can delete your account at any time from account settings. Deletion is permanent and immediate: it removes your profile, your generation history, every image you've generated that's stored with us, your API keys, and your subscription linkage. There's no recovery window and no undo — see the Privacy Policy for the exact mechanics. If you own an organization with other members, you'll need to transfer ownership before you can delete your account, so those members aren't orphaned.

We can suspend or terminate your account for violating these Terms, abusing the Service, or non-payment, with notice where practical. If we terminate your account for cause, you're not entitled to a refund for the remainder of any billing period.


CHANGES AND CONTACT

We may update these Terms as the product changes. If we make a material change, we'll update the date below and, where practical, note it in the changelog. Continuing to use the Service after an update means you accept the revised Terms.
